9th Circuit Affirms Indian Reservations Have Reserved Groundwater Rights

On Tuesday, March 7, 2017 the United States Court of Appeals for the Ninth Circuit affirmed “the district court’s partial summary judgment in favor of the Agua Caliente Band of Cahuilla Indians and the United States, which declared that the United States impliedly reserved appurtenant water sources, including groundwater, when it created the Tribe’s reservation in California’s arid Coachella Valley.”

The full opinion is available here: APPELLATE-#351154-v1-agua_caliente_decision

This is the first successful case to fight for the protection of Indigenous #groundwater rights in the U.S.
